Option Consommateurs filed a class action Cargill, Inc., Cargill Meat Solutions Corp., Cargill Ltd., JBS USA Food Company, Swift Beef Company, JBS Packerland Inc., JBS Canada ULC, Tyson Foods, Inc., Tyson Fresh Meats, Inc., National Beef Packing Company, LLC, in which it is alleged that they conspired to unduly restrict competition related to the production, supply or sale of beef in Québec. For the purpose of this class action, Beef means meat intended for human consumption and produced, inter alia, by the activities of the Defendants.

The class action seeks a judgment ordering to pay to class members an amount equivalent to the sum of revenues generated by the artificially inflated portion of the selling prices of Beef in Québec.

You are a member of the proposed class action if you purchased, in Québec, Beef on or after January 1, 2015.

What is the status of this class action?

On March 24, 2022, an Originating Application to Institute a Class Action was filed in the Québec Superior Court.

The class action is currently at the authorization stage, and on November 1st, 2022, the proceedings were temporarily stayed by the Superior Court of Québec for a period of up to 60 days after a judgment to be rendered by the Supreme Court of British Columbia on the certification of the case Giang Bui v. Cargill, Incorporated, and al. (No. S-221365) or following any other order rendered by the Superior Court of Québec.
