Class action

Class actions were commenced in Québec, British-Columbia and Ontario, on behalf of residents of Canada, alleging that certain LIB manufacturers and their related entities conspired to fix the prices of LIBs, and that this resulted in consumers, businesses, and other purchasers paying too much for LIBs and certain LIB Products purchased in Canada.

LIBs batteries are a type of rechargeable batteries used in electronic products. These batteries are sold separately or within consumer electronic products.

The class action seeks a judgment ordering reimbursement of the artificially inflated portion of the price of LIBs or LIB Products that class members paid.

Who is a member of this class action? 

You are a class member if you purchased LIBs or LIB Products between January 1, 2000 and January 1, 2012.

LIB Products are laptop computers, notebook computers, tablet computers, e-book readers, MP3 players, personal digital assistants, handheld GPS, handheld video players, cellphones, smartphones, or replacement batteries for any of these products (“LIB Products”)

What is the status of this class action?

Settlements totalling CDN$21.3 million were reached with the defendants NEC, Samsung, Sony, LG, Toshiba, Maxell, and Panasonic. The settlement agreements have received court approval in Ontario and Québec. The settlement agreements resolve the litigation in full.

The Claims Deadline has now passed, and no further claims can be filed. 

The Claims Administrator, Ricepoint Administration Inc., is now reviewing the claims received and will contact you if further information is required. Payment to Class Members who filed for the minimum $20 payment (Undocumented Claims) is currently underway. Payment to Class Members who filed a claim for more than $20 (Documented Claims) will be issued subsequently.
