Class action

A class action has been  brought against Espar Inc., Espar Climate Control Systems, Eberspaecher Climate Control Systems International Beteiligungs-GmbH, Eberspaecher Climate Control Systems GmbH & Co. KG (previously doing business as “J. Eberspaecher GmbH & Co. KG”), Eberspaecher Gruppe GmbH & Co. KG, Espar Products Inc., Webasto SE, Webasto Thermo & Comfort SE, and Webasto Thermo & Comfort North America Inc. (collectively, the “Defendants”) with respect to parking heaters for use in commercial vehicle cabins. The Defendants are alleged to have failed to comply with their legal and statutory obligations, notably by conspiring to unduly restrict competition and to unreasonably raise the selling price of parking heaters for use in commercial vehicle cabins (hereinafter, the “Cartel”).

The class action seeks to obtain a judgment ordering the Defendants to pay to class members an amount equal to the sum of revenues generated by the Defendants and other members of the Cartel from the artificially inflated portion of the selling price of parking heaters for use in commercial vehicle cabins purchased in Québec and/or the sale, lease, or sublease price of products equipped with one or more parking heaters for use in commercial vehicle cabins purchased, leased or subleased in Québec.

Who is a member of this class action? 

You are a member of the class action if you purchased, in Québec, one or more parking heaters for use in commercial vehicle cabins or if you purchased, leased, or subleased in Québec one or more products equipped with one or more parking heaters for use in commercial vehicle cabins from September 13, 2001 to December 31, 2012.

What is the status of this class action?

On February 14, 2018, an Originating Application was filed before the Superior Court of Québec.

The case is currently at the merits stage.
