Class action

A class action is brought against Volkswagen AG, Dr. Ing. HCF Porsche AG and Porsche Cars Canada Ltd. alleging that the latter failed to comply with their legal and statutory obligations, notably by fraudulently manipulating the compliance tests of model years 2007 to 2018 gasoline-powered Porsche vehicles sold in Canada, as a result of which these vehicles emit more pollutants and consume more gasoline on the road than during compliance tests.

The class action seeks to obtain a judgment ordering the payment of $10,000 to each member of the proposed class. In addition, for members of the proposed class who own substandard vehicles, the class action also seeks the cancellation of their sales contract and the reimbursement of the purchase price and incidental expenses incurred at the time of purchase. For members of the proposed class who lease substandard vehicles, the class action also seeks to obtain the cancellation of their lease agreement and the reimbursement of all payments made.

Finally, the class action seeks to obtain payment of $25 million in punitive damages.

You are a member of the proposed class if you purchased or leased, in Québec, a model year 2007 to 2018 gasoline-powered Porsche vehicle.

What is the status of this class action?

On March 8, 2021, an Application for Authorization to Institute a Class Action was filed before the Superior Court of Québec.

The class action is currently at the authorization stage, and on June 2, 2021, the proceedings were temporarily stayed by the Superior Court of Québec for a period of ten (10) months following the filing of the plaintiff’s certification record in the related case before the Supreme Court of British Columbia in Trevor Stone v. Dr. Ing. HCF Porsche AG et al. (No. S-210991) or following any other order rendered by the Superior Court of Québec.
