Class action

A class action is brought against Hino Motors, Ltd., Toyota Motor Corporation and Hino Motors Canada, Ltd., alleging that the latter failed to comply with their legal and statutory obligations, notably by fraudulently manipulating the compliance tests of model years 2004 to 2021 vehicles inclusive, equipped with Hino brand diesel engines of models A05C, A09C, E13C, N04C, J05D, J05E or J08E sold in Canada, as a result of which these vehicles emit more pollutants and consume more fuel on the road than during compliance tests.

The class action seeks to obtain a judgment ordering the payment of $10,000 to each member of the proposed class.

In addition, for members of the proposed class who own substandard vehicles, the class action also seeks the cancellation of their sales contract and the reimbursement of the purchase price and incidental expenses incurred at the time of purchase. For members of the proposed class who lease substandard vehicles, the class action also seeks to obtain the cancellation of their lease agreement and the reimbursement of all payments made.

Finally, the class action seeks to obtain payment of $25 million in punitive damages.

Who is a member of this class action?

You are a member of the proposed class if you purchased or leased, in Québec, a model years 2004 to 2021 vehicle inclusive, equipped with Hino brand diesel engines of models A05C, A09C, E13C, N04C, J05D, J05E or J08E. In particular, buyers or lessees of Hino brand vehicle models 155, 195, 238, 258, 268, 338, M series, L series and XL series from model years 2004 to 2021 are included in the group.rie XL d’années-modèles 2004 à 2021 sont notamment inclus dans le groupe.

What is the status of this class action?

On November 1st, 2023, the Plaintiff filed an Application for Authorization to Institute a Class Action before the Superior Court of Québec.

The class action is currently at the authorization stage.
