Class action
Option consommateurs filed a class action against Home Depot of Canada Inc. alleging that it failed to comply with its legal and statutory obligations by, among other things, sharing personal information with Facebook without the consent of the members of the proposed class and violated their fundamental right to privacy.
The class action seeks a judgment ordering Home Depot of Canada Inc. to pay members of the proposed class an amount equal to the value of the personal information disclosed to third parties for commercial purposes without their consent. The action further seeks payment by Home Depot of Canada Inc. of $10 million in punitive damages. Finally, the action seeks reimbursement of the amounts incurred by the proceedings and for any investigation relating to this matter.
Who is a member of this class action?
You are a member of the class action if you have a Facebook account, purchased or leased a good or service in Quebec from a Home Depot store or on the Homedepot.ca website, and provided your email address between January 1, 2018, and October 30, 2022.
What is the status of this class action?
On January 27, 2023, an Application for Authorization to Institute a Class Action was filed in the Superior Court of Québec.
On February 13, 2026, the Court of Appeal of Québec authorized the institution of the class action.
The class action is currently proceeding to the merits stage.
